  1. Per-Renewal Engagement Model: Our Trademark Renewal plans are per-renewal engagements (one engagement, one TM-R filing for the specified class / classes). The plan covers our work from registration verification through Renewal Certificate delivery. THE LIFELONG REMINDER POLICY runs in addition — 90 / 60 / 30 / 7-day reminders before next expiry, then continues for every subsequent 10-year cycle.
  2. Plan Eligibility (3 Tiers — by Service Scope): (a) ELEMENTAL (₹1,999) — STANDARD RENEWAL: Form TM-R filing + Govt fee payment + DSC affixation by LT + Challan & Acknowledgement delivery; LT's Attorney is already the TM agent on record. (b) ENRICHED (₹3,499) — +ATTORNEY CHANGE: Power of Attorney (Form TM-48) drafting + Authorisation Letter drafting + change-of-Attorney filing + then full renewal per Elemental; for cases where LT is being newly engaged. (c) SUPREME (₹9,999) — +TRADEMARK WATCH: Full renewal process (per Elemental OR Enriched as applicable) + 12 MONTHS of Trademark Watch Services (IP India Journal monitoring + similar-mark alerts + opposition window tracking + monthly watch reports). All plans include the LIFELONG REMINDER POLICY.
  3. LIFELONG REMINDER POLICY (Our Binding Commitment): Once we file your renewal, our reminder calendar is set for the NEXT renewal cycle (10 YEARS forward). We send proactive REMINDERS at 90 days / 60 days / 30 days / 7 days before the next expiry date. We CONTINUE cycling these reminders for EVERY SUBSEQUENT 10-YEAR CYCLE until either: (a) your business is FORMALLY CLOSED / wound up (we update our records on intimation), OR (b) you EXPLICITLY ASK us to STOP REMINDERS (written email to our team). No additional charge for the reminder policy — it is INCLUDED in every plan tier.
  4. Statutory Anchor: Trademark Renewal is governed by SECTION 25 of the Trade Marks Act, 1999 + RULE 57 of the Trade Marks Rules, 2017. The application form is FORM TM-R (renewal + late renewal + restoration). For restoration, an additional FORM TM-18 (Affidavit supporting the statement of the case for restoration) is required. Power of Attorney is FORM TM-48. Filed on the IP India online portal (https://ipindiaonline.gov.in).
  5. Renewal Windows (Critical): RENEWAL CAN BE FILED: Up to 1 YEAR BEFORE expiry (Section 25(3) / Rule 57). LATE RENEWAL with SURCHARGE: Within 6 MONTHS POST-EXPIRY (Section 25(4) proviso). RESTORATION (Mark already removed from register): 6 to 12 MONTHS POST-EXPIRY (Section 25(5) read with Rule 60) — Form TM-R + Form TM-18 + statement of case; at Registrar's discretion. BEYOND 1 YEAR POST-EXPIRY: Mark is PERMANENTLY REMOVED from the register; a fresh application is the only option (losing your priority date + brand seniority).
  6. Government Fees — Renewal Stage (Per Class — Pass-Through at Actuals): ON-TIME Renewal e-filing fee: ₹9,000 per class — UNIFORM FOR ALL APPLICANTS (Individuals, DPIIT Startups, Udyam MSMEs, Companies, LLPs, Partnerships — same fee). LATE RENEWAL with surcharge (within 6 months post-expiry): ₹13,500 per class (₹9,000 renewal + ₹4,500 surcharge). RESTORATION (6–12 months post-expiry, Form TM-R + Form TM-18): ₹18,000 per class (combined). Per First Schedule of the Trade Marks Rules, 2017. IMPORTANT: The 50% rebate (₹4,500 vs ₹9,000) that helps Individual / Startup / MSME applicants at the INITIAL FILING stage (Form TM-A) does NOT extend to renewal — the reduced track was deliberately limited by the 2017 Rules to FILING + EXPEDITED EXAMINATION only. MULTI-CLASS renewals are MULTIPLICATIVE — each additional class is a separate filing fee. Physical filing rates are listed in the First Schedule but are essentially obsolete in 2026 practice; we file e-filing only.
  7. Late Renewal / Restoration Add-On (Where Plan Doesn't Cover Default): If your trademark has crossed expiry and falls into LATE RENEWAL (within 6 months — Govt fee ₹13,500/class uniform) or RESTORATION (6–12 months — Govt fee ₹18,000/class uniform combined) territory, we still file via the same Form TM-R (and Form TM-18 for restoration). The additional government fee (surcharge / restoration combined fee) is pass-through at actuals. Where significant restoration drafting work is involved (Form TM-18 affidavit + Statement of Case), an additional professional fee of ₹1,499 + GST may apply — quoted upfront after status review.
  8. GST on Our Fee: All quoted prices are exclusive of GST @ 18%, charged at checkout.
  9. Single-Class Default + Multi-Class Add-On: ALL THREE TIERS cover ONE CLASS by default. Additional classes are billed at actual plan + GST per class (professional fee) + government fee per class (at actuals). We discuss multi-class strategy in the discovery call before quoting the final amount.
  10. Trademark Watch Services (Supreme Tier — Inclusions): 12 MONTHS of watch starting from Renewal Certificate issuance. INCLUDES: (i) IP India Trademark Journal monitoring for similar / identical marks in the same / related classes, (ii) Opposition window alerts (4-month statutory window from Journal publication), (iii) Domain-name watch for typo-squat / lookalike domains on the renewed mark, (iv) Marketplace watch (Amazon Brand Registry + Flipkart Brand Centre + major e-commerce platforms) for infringing listings, (v) Monthly consolidated watch report emailed to client. EXCLUDES: actual opposition filing (separate engagement at ₹4,999 + GST + Govt fee per opposition); UDRP / domain disputes; marketplace takedown actions (separate engagement). Watch service renewable at standalone tariff after 12 months.
  11. Refund Policy: Full refund of professional fee (less ₹499 documentation handling) is available if the TM-R application is NOT FILED within 7 working days from receipt of all required documents + POA + government fee. Government fees, if already paid to IP India, are NON-REFUNDABLE. The watch service component of Supreme is non-refundable once activated.
  12. Out-of-Scope Items: Fresh Trademark Application Filing (separate LT service — for marks needing re-registration post 1-year-removal), Trademark Assignment / Transmission (Form TM-P), Trademark Rectification / Cancellation, Madrid Protocol international renewals (separate filing system), IPAB / Tribunal / Court appellate matters, Trademark Opposition filing (separate engagement), Customs Recordal updates, Brand Audit / IP Valuation, Patent / Copyright / Design renewals (separate IP categories). These are quoted separately as needed.
  13. Reminder Stop / Modification Process: To STOP reminders, send an email to our designated email ID confirming: (a) the trademark registration number(s) for which reminders should stop, (b) the reason (business closure / mark not in use / other). To MODIFY reminders (e.g., update contact email / phone / authorised signatory), send the updated details. Reminders resume only on written request. We do not invoice for paused / stopped reminders.

Important Notes

  • 1 YEAR BEFORE TO EXPIRY DATE = ON-TIME WINDOW: Standard renewal at ₹9,000 per class — UNIFORM for all applicants (no MSME / Startup rebate at renewal). No surcharge. This is the sweet spot — we recommend renewing 3–6 months before expiry to avoid last-minute surprises.
  • WITHIN 6 MONTHS POST-EXPIRY = LATE WITH SURCHARGE: Section 25(4) proviso allows renewal here but adds a ₹4,500 SURCHARGE per class. Total: ₹13,500 per class for ALL applicants. The mark stays on the register during this 6-month grace period.
  • 6 TO 12 MONTHS POST-EXPIRY = RESTORATION (Form TM-18): Section 25(5) read with Rule 60. The mark is removed from the register; restoration is at the REGISTRAR'S DISCRETION. Combined Govt fee ₹18,000 per class. NO GUARANTEE — the Registrar considers third-party interests + public interest before allowing restoration.
  • BEYOND 12 MONTHS POST-EXPIRY = PERMANENTLY LOST: The mark is REMOVED from the register; you have NO PATH TO RESTORATION. The only option is to file a FRESH trademark application (losing 10/20/30+ years of brand seniority + priority date + customs recordal status + e-commerce brand-protection status). Our Lifelong Reminder Policy is designed to make sure this never happens to you.

Then we proceed with the standard renewal.

Applicant Identity

For INDIVIDUAL proprietors: PAN + Aadhaar + photograph + residence address proof. For sole proprietorship firms holding the mark: the proprietor's personal PAN suffices.

For AGENT CHANGE cases (Enriched / Supreme): Power of Attorney (FORM TM-48) executed by the proprietor in favour of Legal Terminus. Authorisation Letter (for entities) confirming the signatory's authority to execute POA on behalf of the company / LLP. WE DRAFT both documents; you sign on ₹100 stamp paper. We coordinate stamping. Not required for Elemental (LT already on record).

Status Documents (Recordal Update Only — No Renewal Rebate)

GOOD TO KNOW: The 50% Govt fee rebate (₹4,500) for Individual / DPIIT Startup / Udyam MSME applicants is a FILING-STAGE benefit (Form TM-A) — it does NOT apply at renewal. Renewal Govt fee is uniform ₹9,000 per class. However, where the trademark's recordal needs updating (e.g., proprietor recently obtained Udyam registration, address has changed, entity converted), we can file Form TM-M alongside the renewal to keep the register clean. Add-on at ₹999 + GST + Form TM-M Govt fee.

Restoration Statement of Case + Form TM-18 (Restoration cases only)

For RESTORATION cases (within 1 year post-expiry): FORM TM-18 (Affidavit) declaring the reasons for delay in renewal + the proprietor's continued intent to use the mark. STATEMENT OF CASE explaining why restoration is warranted (e.g., genuine oversight, business circumstances, change in personnel, etc.). Supporting evidence of continuous use of the mark in commerce. We draft the affidavit + Statement of Case; you sign before a notary.
