By subscribing to any of the above plans, you agree to the following terms and conditions. Please read them carefully before proceeding.

  1. Government Fee: ESIC Registration government fee is NIL under the ESIC unified portal. Our fee covers professional services — advisory, Form 1 drafting, portal filing, Insurance Number (IP) generation, family declaration capture, and post-registration support.
  2. GST on Our Fee: All quoted prices are exclusive of GST @ 18%, charged at checkout.
  3. Mandatory Registration Trigger: ESIC Registration is mandatory under Section 1(5) of the ESI Act, 1948 once your non-seasonal establishment has 10 or more employees (20 in certain states — we verify on the discovery call). Registration must be filed within 15 days of crossing the threshold.
  4. Wage Threshold for Mandatory Coverage: Employees earning gross wages up to ₹21,000 / month are mandatorily covered under ESIC (₹25,000 for persons with disabilities). Employees earning above ₹21,000 are not covered, even if they want to opt in — the cap is statutory.
  5. Contribution Rates (FY 2025-26): Employer contribution 3.25% of gross wages. Employee contribution 0.75% of gross wages. Total 4% of gross wages, deducted monthly and remitted by the 15th of next month.
  6. Employee Capacity per Plan: Elemental covers IP generation for up to 10 employees. Enriched up to 10–30 employees. Supreme up to 30–50 employees. Additional employees beyond plan limits shall be decided upon negotiation.
  7. Monthly Compliance Out-of-Scope: Plans do NOT include ongoing monthly contribution filing (beyond the included first-1 walkthrough in Enriched / first-3 in Supreme), annual returns, grievance handling, benefit claim assistance for individual employees, Section 45A determination representation, or Inspector visits / inquiries. These are billed under our monthly Payroll Compliance retainer (starting ₹1,999 / month for ESIC only).
  8. Out-of-Scope Items: Sub-code registration for branches (quoted separately), inter-state contractor compliance, Atal Bimit Vyakti Kalyan Yojana / RGSKY claim assistance for terminated employees, ESIC inspection representation, Section 75 cases (Insurance Court matters), Section 85 prosecution defence, and conversion of exempted to unexempted establishment are not included and quoted separately on request.

Important Notes

  • Once your headcount touches 10, you have 15 days to register. Delayed registration attracts interest under Section 39(5) + damages under Section 85B — up to 25% of arrears. Don't wait until an Inspector visit catches you.
  • Family declaration matters more than people think. Dependants listed in the declaration are eligible for ESIC medical benefits + dependants' benefit (90% wages) in case of employment-related death. Wrong declaration = denied claims. We capture this carefully for every covered employee.
  • ESIC coverage is geographic — implemented in stages. Some new industrial estates / Tier-3 cities may not yet be notified. If you're in an un-notified area but voluntarily covered, scope can be limited. We verify notified-area status before filing.
  • ESIC wage threshold (₹21,000) hasn't been revised since January 2017 — and is widely expected to be increased. When it is, more employees will become covered overnight without separate notification. Plan your payroll structure with this expansion risk in mind.

Why Register for ESIC

ESIC Registration isn't optional once you cross 10 employees in a notified area. The Employees' State Insurance Act, 1948 was India's first social security legislation — it provides covered employees and their families with comprehensive medical care, cash benefits during sickness / maternity / disability, and dependants' benefits in case of employment-related death. For employers, ESIC compliance is a statutory must-do; for employees earning gross wages up to ₹21,000, it's a genuine social-security net that they often only realise the value of when they actually need it.

ESIC contribution is also low for the employer — just 3.25% of gross wages. For that, your covered employees get free OPD + IPD care at ESIC dispensaries and hospitals for themselves and their family (spouse, parents, children), cash benefits during sickness (70% wages for up to 91 days), maternity benefits (100% wages for 26 weeks), disablement benefits (90% wages), dependants' benefits, and funeral expenses. Rupee-for-rupee, ESIC is one of the highest-value social-security contributions an employer makes.

Types of ESIC Registration in India

Factory Establishment ESIC

For establishments covered under the Factories Act, 1948 — manufacturing units with 10+ workers using power, or 20+ workers without power. Triggered automatically when the factory commences operation. Most common ESIC variant; covers all wage-eligible workmen + supervisors.

Shop & Commercial Establishment ESIC

For Shops & Commercial Establishments covered under state Shops & Establishments Acts — offices, retail outlets, restaurants, cinemas, hotels, etc. ESIC coverage extended to S&E establishments via state notifications. Common for IT / BPO / retail / hospitality businesses.

Notified Industries ESIC

Specific industries notified under Section 1(5) — educational institutions, medical institutions, security services, contract employment, cinema, hotels, restaurants. May have different thresholds (10 vs 20) and special compliance norms. Industry-specific advisory needed.

Sub-Code (Branch) Registration

When you already have an ESIC Employer Code and open new branches in different ESIC regional offices' jurisdictions. Sub-code allows branch-level compliance under the parent code. Useful for multi-state employers maintaining centralised payroll but distributed operations.

Contractor / Inter-State Worker ESIC

For principal employers engaging contractors with their own employees, OR contractors directly registering. Compliance under Section 1(4) read with the Contract Labour (R&A) Act. Critical for IT services, construction, security, housekeeping firms — one compliance gap can shift liability to the principal employer.

Voluntary ESIC Coverage

Establishments below 10 employees can voluntarily seek ESIC coverage if employee-employer mutual agreement is in place. Less common than mandatory route; coverage must be sustainable from contribution-day-one. Useful for smaller employers wanting to offer ESIC as a benefit.

Benefits of ESIC Registration in India

ESIC isn't just a deduction — it's a comprehensive social-security cover for your covered employees and their families. Here's what genuinely matters once you're registered:

Free Medical Care (OPD + IPD)

Covered employees + their family members (spouse, dependent parents, dependent children up to age 25) get free outpatient care, hospitalisation, surgery, and specialist consultations at ESIC dispensaries and tie-up hospitals. No cost ceiling. Effectively a fully-loaded health insurance plan at 0.75% employee contribution.

Sickness Benefit (70% Wages)

Cash payment of 70% of average wages for up to 91 days in a year for non-employment-related sickness (with medical certificate). Extended Sickness Benefit available for chronic conditions (TB, cancer, leprosy etc.) — up to 80% wages for up to 2 years.

Maternity Benefit (100% Wages)

Female covered employees receive 100% of average wages for 26 weeks (12 weeks for confinement, balance for prenatal + postnatal). Additional 1 month extra in case of complication / miscarriage. Plus confinement expenses of ₹7,500 where ESIC facility not used.

Temporary & Permanent Disablement Benefit

90% of average wages paid for any temporary disablement from an employment injury (no minimum period). For permanent disablement, lifetime monthly pension based on loss of earning capacity. Far better than statutory minimums under workmen's compensation.

Dependants' Benefit + Funeral Expenses

If a covered employee dies due to employment injury, dependants receive 90% of average wages as monthly pension — widow lifelong, children till age 25, dependent parents on means basis. Plus ₹15,000 funeral expenses to whoever performed the funeral.

Unemployment Allowance (ABVKY / RGSKY)

Atal Bimit Vyakti Kalyan Yojana (ABVKY) — covered employees who lose their job due to retrenchment / closure receive unemployment allowance of 50% of average wages for up to 90 days. Rajiv Gandhi Shramik Kalyan Yojana provides up to 12 months unemployment allowance + medical care during the period.
