  1. Government Fee: Stamp duty on Trust Deed (Rs.500 - Rs.5,000 state-specific), Sub-Registrar / Charity Commissioner filing fee (Rs.100 - Rs.1,500), and notarisation (Rs.100 - Rs.500) are payable to the respective state authorities and reimbursed at actuals. Our fee covers professional services - Trust Deed drafting, advisory, registration coordination, (Enriched) 12A + 80G filing, and (Supreme) UDYAM + GST.
  2. GST on Our Fee: All quoted prices are exclusive of GST @ 18%, charged at checkout.
  3. State Variation - Public Trust Acts: Maharashtra (Maharashtra Public Trusts Act 1950 / earlier Bombay PTA), Gujarat, and Madhya Pradesh have their own Public Trusts Acts administered by the Charity Commissioner. Other states route Trust registration through the Sub-Registrar's office under the Registration Act, 1908. We confirm state-specific process on the discovery call.
  4. Trust Structure: Minimum 2 trustees (no maximum). Settlor (Author of the Trust) initiates; settlor may also be a trustee. Beneficiaries can be specific (Private Trust) or the public at large (Public Charitable Trust). At least one trustee should be a resident in India.
  5. 12A / 80G / NGO Darpan / CSR-1 / FCRA: These are SEPARATE registrations under the Income Tax Act, MCA CSR rules, and FCRA respectively - NOT automatic with Trust registration. The Enriched tier includes 12A + 80G applications. CSR-1 + Darpan ID + FCRA are quoted separately. (FCRA registration ITSELF takes 6-12 months and requires 3 years of trust existence + Rs.15 lakh annual charitable spend).
  6. Refund Policy: Full refund of professional fee (less Rs.1,999 documentation handling) is available if Trust Deed is not finalised within 7 working days from receipt of complete trustee + settlor inputs. Stamp duty and notarization costs if already paid are non-refundable.
  7. Out-of-Scope Items: NGO Darpan registration, CSR-1 filing, FCRA application, Conversion of existing Society / Section 8 Company to Trust (or vice versa), foreign trustee KYC + apostille, registered office shifting, Trust Deed amendments (beyond first registration), trust property registration / transfer, beneficiary changes, and any benefit / scheme applications (12A renewal beyond first 5 years, FCRA renewal, government grant applications, etc.) are not included and quoted separately.
  8. Post-Registration Compliance: Plans do not include statutory audits (mandatory if income > Rs.50,000 - varies by state), ITR-7 annual filing, Form 10B audit report (for 12A entities), Form CSR-2 filings, ROC / Charity Commissioner annual returns, or trustee remuneration approvals. These are billed under our Annual Compliance retainer for non-profits.
  9. Out-of-Scope - Grants / Benefits: We do NOT offer application support for government grants, CSR funds, foreign donations through FCRA, public donation campaigns, or any benefit claim applications under central / state schemes. Our scope is the foundational registrations only. For grant / benefit applications, please engage a specialist or apply directly to the respective authority once registered.

Important Notes

  • Object clause must be SPECIFIC and CHARITABLE. Generic 'social welfare' clauses get rejected for 12A. Education, healthcare, environment, poverty alleviation - each demands precise framing. We stress-test the object before drafting.
  • Stamp duty is state-specific and depends on the trust's property value. Maharashtra: Rs.500 typically; Karnataka: Rs.1,000 typically; some states with sizeable trust corpus may attract higher slabs. We calculate precisely on the discovery call.
  • Minimum 2 trustees required. Same person CAN be both settlor AND trustee - but can't be the SOLE trustee (the Trust would lack legal capacity). Plan trustee composition before drafting the Deed.
  • 12A and 80G are SEPARATE applications (under the Income Tax Act, not Indian Trusts Act). Without them, your Trust pays 30% income tax and donors get no tax benefit. Apply within 1 year of registration for cleanest treatment. The Enriched tier handles this.

Public Charitable Trust

The default for NGOs, foundations, and impact vehicles. Object: relief of poverty, advancement of education, healthcare, environment, social welfare, advancement of public utility. Beneficiaries are the public at large (or a class of public). 12A + 80G + CSR-1 + FCRA eligible. Most common Trust type.

For specific beneficiaries - family, individuals, or a small group. Governed by the Indian Trusts Act, 1882. Public Religious Trust

For religious purposes - temple management, religious endowments, places of worship. Object focuses on religious teaching, practice, propagation. Religious denomination matters for the object clause. In some states (Maharashtra, Karnataka) governed by separate religious endowment legislation.

Tax Exemption (12A)

Once registered under Section 12A of the Income Tax Act, the Trust's income is exempt from income tax (subject to applying 85%+ to charitable objects in the year). Without 12A, your 'non-profit' pays 30% income tax on surplus. The Enriched tier handles this via Form 10A.

Donor Tax Deduction (80G)

Perpetual Succession

The Trust (Public Trust) can hold property, sign contracts, sue and be sued, open bank accounts, all in its own name. Trustees come and go via Deed of Adherence; the Trust continues. Perpetual succession built into the Deed.

Trust setup is one of the cheapest non-profit options (Rs.5K - Rs.15K total) and ongoing compliance is lighter than Section 8 Company - no MGT-7 / AOC-4 / DIR-3 / mandatory MCA filings. Just income tax compliance + state-specific annual return where applicable.

CSR-Eligible (with CSR-1)

Trusts with CSR-1 registration (Supreme tier) become eligible to receive CSR funds from Indian companies. The Indian CSR pool is Rs.25,000+ crore annually - and registered Trusts compete head-to-head with Section 8 Companies and Societies for these funds.

Long-Term Mission Control

Trust is the most founder-friendly non-profit structure - the Settlor's vision is enshrined in the Trust Deed, and trustees are bound by it. Unlike Society (member-driven) or Section 8 Company (board-driven), Trust gives the founder long-term control over the mission's direction.
