  3. Statutory Anchor: Trademark Applications are governed by the TRADE MARKS ACT, 1999 + TRADE MARKS RULES, 2017 + the Nice Classification of Goods and Services (10th–11th edition). Filed on the IP India online portal (https://ipindiaonline.gov.in) operated by the Trade Marks Registry under the Controller General of Patents, Designs and Trade Marks (CGPDTM), Ministry of Commerce & Industry.
  4. Government Fees (Per Class — Pass-Through at Actuals): TM-A filing fee per class (e-filing): ₹4,500 for Individual / DPIIT Startup / Udyam MSME applicants; ₹9,000 for Companies / LLPs / Partnerships (non-MSME). Per First Schedule of the Trade Marks Rules, 2017. NOTE: Physical filing rates exist in the Rules (₹500 higher) but PHYSICAL FILING IS ESSENTIALLY OBSOLETE in 2026 practice — we file ONLY via the IP India online portal (https://ipindiaonline.gov.in) which is the standard + faster + entitled to the 10% lower fee. MULTI-CLASS FILINGS ARE MULTIPLICATIVE — each additional class is a separate filing fee. Opposition: ₹2,700 per class. Renewal: ₹9,000 per class (₹4,500 with rebate). All government fees are NON-REFUNDABLE.
  5. GST on Our Fee: All quoted prices are exclusive of GST @ 18%, charged at checkout.

  7. Examination Report Handling (Supreme + Supreme Plus): The Examination Report is typically issued within 3–6 months of filing. Under Section 18 of the Trade Marks Act, the applicant has 30 DAYS to respond. Supreme tier covers MAX 2 DEPARTMENTAL QUERY RESPONSES (initial + follow-up). Additional query responses beyond 2 are billed at ₹2,999 per response.
  8. Hearing + Opposition (Supreme Plus): Trademark Hearing under Rule 41 is scheduled by the Registry where examination objections persist OR an opposition is contested. Supreme Plus covers MAX 2 HEARINGS. Opposition under Section 21 — we file Counter-Statement + coordinate through evidence-led hearing (1 OPPOSITION HANDLED per plan). Additional hearings / oppositions beyond plan limits are billed at ₹4,999 per hearing / ₹7,999 per additional opposition.
  9. User Affidavit + Evidence of Prior Use (Enriched onwards): For prior-use claims, we draft a User Affidavit (sworn statement) declaring the date-of-first-use of the mark in commerce + the goods / services covered. We coordinate evidence: invoices, advertisements, social media history, GST returns, website screenshots, third-party endorsements, packaging samples. Authenticity of evidence is the client's representation; we structure presentation.
  10. Outcome Disclosures: Trademark registration is at the discretion of the Registry + subject to publication in the Trade Marks Journal + 4-month opposition window post-publication. Typical timeline: 12–24 months for clean cases; 24–36+ months where objections / oppositions arise. WE DO NOT GUARANTEE registration outcome — the Registry's decision is final. Trademark registration in Odisha

Know what is Trademark?

A trademark is a special word, letter, or symbol that makes your brand unique and easy to recognize. It gives your brand legal protection, so others can't use a similar name or logo. This protects your brand's identity and prevents trademark disputes.

To register a trademark in India, you apply through the IP India Office. Once registered, your trademark is protected for 10 years, and you can renew it to keep the protection.

Before applying, it's important to do a trademark search to make sure no one else is already using a similar mark. There are different types of trademarks, like certification marks, which help protect your products or services. After registration, you can use the ® symbol to show your trademark is officially protected.

Types of Trademark Registration

In India, trademarks play a crucial role in protecting the identity of businesses and their products or services. Governed by the Trademark Act, 1999, trademarks can include various elements such as logos, shapes, sounds, or designs that make a brand unique. These trademarks safeguard businesses by distinguishing their goods or services from others and providing legal protection against unauthorized use. This helps businesses maintain their uniqueness, prevent imitation, and avoid infringement, ensuring their brand remains secure in a competitive market.

Name Mark

You can register your first name or surname or complete name for trademark so that no one can copy your name.

Example: Name of Shah Rukh Khan

Invented Word

An invented word trademark registration is when you protect a completely unique, made-up word as your brand name. Since the word is original and doesn't exist in any dictionary.

Example: Zomato, Swiggy

Letters or Numerical Mark

You can register letters, numbers, or a combination of both as a trademark if they are unique and distinctive. This type of trademark protects combinations that represent your brand, preventing others from using them in a similar context.

Example: hp

Device Mark

A Device Mark refers to a trademark that includes a logo, design, symbol, or any graphic element that uniquely represents your brand. Unlike word marks, which focus solely on the text, device marks emphasize the visual components associated with your brand.

Example: Allen Solly

Monogram Mark

A Monogram Trademark is a logo or symbol consisting of letters (often initials) that are designed in a stylized, interconnected manner to represent a brand.

Example: Legal Terminus LT

Colour Mark

A Colour Mark is a trademark that protects a specific color or a combination of colors that is used uniquely by a brand. The color(s) must be associated with the brand and serve as an identifier for the brand's goods or services.

Example: Coca-Cola Red

Shape Mark

A Shape Mark is a type of trademark that protects the product shape or packaging shape or store layout of a product or its container.

Example: Appy Fizz

Sound Mark

A Sound Mark is a type of trademark that protects a unique sound used to represent a brand or product. These marks can include jingles, musical notes, or other distinctive sounds that are strongly associated with a brand.

Example: Tune of Nokia

Signature Mark

A Signature Trademark is a type of personalized signature that is used as a distinctive brand identifier. This could be the signature of the founder, CEO, or any significant figure associated with the brand.

Example: Signature of Sachin Tendulkar

Types of Trademark Symbols

TM Symbol (™)

The TM symbol shows that a brand is claimed by its owner, even if the trademark is not officially registered yet. It offers some level of protection, especially in case of brand disputes or misuse.

R Symbol (®)

The R symbol means the trademark is officially registered with the authorities. It gives full legal protection and ensures only the owner can use the brand for specific goods or services.

Understanding Rights of a Registered Trademark User

The registration of a trademark grants its owner specific legal rights that are crucial for protecting their brand. Owning a registered trademark does not just allow the owner to use the mark; it primarily provides the legal authority to prevent others from using the same or a confusingly similar mark on related goods or services. This protection is essential for maintaining the uniqueness of a brand in a competitive market. These rights are confined within the territorial bounds of the country where the trademark is registered.

Enforcement and Legal Protections Against Infringement

Enforcing trademark rights is crucial for maintaining the economic value of a trademark and protecting business interests.

Control Over Licensing and Assignment

Registered trademark owners have control over the licensing and assignment of their trademarks. This enables them to authorize others to use their trademarks under specified conditions without losing their ownership rights.

Prevention of Unfair Competition

Trademark registration helps prevent unfair competition by prohibiting competitors from using similar distinguishing signs that can confuse consumers. This right helps maintain the uniqueness of the brand and ensures fair market competition.

Enhancement of Business Value

Registered trademark significantly enhance the value of a business, transforming them into recognizable symbols of quality and trust.

Trademark Registration — FAQs

Got questions? We've got answers — straight, no-BS, legally accurate.

Yes. You can use the ™ symbol immediately after filing your trademark application or even while claiming ownership of a brand. It indicates that you are claiming rights over the mark. However, the ® symbol can only be used after the trademark is officially registered by the Trade Marks Registry.
™ means Temporary Mark — the mark is being claimed as a trademark, whether registered or not. ® means Registered Mark — the trademark is officially registered under the Trade Marks Act, 1999 and enjoys statutory protection. Using ® without registration is illegal and may attract penalties.
Yes. Your business name, logo, tagline, product name, and even packaging style can be protected separately under trademark law. Many businesses file separate applications for: • Brand Name (Wordmark) • Logo Device • Tagline / Slogan • Product Names Separate filings provide stronger and wider legal protection.
Yes. A registered trademark in India gives nationwide protection across all States and Union Territories, irrespective of where your business is currently operating.
Sometimes yes — but only if they operate in completely different classes or industries and there is no likelihood of consumer confusion. For example, identical names may coexist if one is in clothing and another is in software, subject to registry approval.
Yes. An individual can file a trademark application in their personal name even before incorporating a company or LLP. This is common for startups and founders who want to secure the brand early.
Trademark classes are categories of goods and services defined under the NICE Classification system.
