Trademark registration in India protects your business name, logo, or symbol, giving you the legal right to stop others from copying or using it without permission. The process starts with a trademark search to see if your name or logo is available. Then, we help you file your trademark application with IP India, a government body.
At Legal Terminus, we guide you through every step of the process. We handle all the paperwork, help you pick the right trademark class (from 45 available classes), and track your application status until you receive the trademark certificate. Your trademark is valid for ten years and can be renewed easily.
Trademark registration gives your brand long-term legal protection, covering specific goods or services in different categories (classes 1–34 for goods and classes 35–45 for services). Our fees are transparent, and we ensure a smooth registration process. Protecting your brand with a trademark is a smart step to secure your business identity.
A trademark is a special word, letter, or symbol that makes your brand unique and easy to recognize. It gives your brand legal protection, so others can’t use a similar name or logo. This protects your brand’s identity and prevents trademark disputes.
To register a trademark in India, you apply through the IP India Office. Once registered, your trademark is protected for 10 years, and you can renew it to keep the protection.
Before applying, it’s important to do a trademark search to make sure no one else is already using a similar mark. There are different types of trademarks, like certification marks, which help protect your products or services. After registration, you can use the ® symbol to show your trademark is officially protected.

In India, trademarks play a crucial role in protecting the identity of businesses and their products or services. Governed by the Trademark Act, 1999, trademarks can include various elements such as logos, shapes, sounds, or designs that make a brand unique. These trademarks safeguard businesses by distinguishing their goods or services from others and providing legal protection against unauthorized use. This helps businesses maintain their uniqueness, prevent imitation, and avoid infringement, ensuring their brand remains secure in a competitive market.
You can register your first name or surname or complete name for trademark so that no one can copy your name.
Example: Name of Shah Rukh Khan
An invented word trademark registration is when you protect a completely unique, made-up word as your brand name. Since the word is original and doesn’t exist in any dictionary.
Example: Zomato, Swiggy
You can register letters, numbers, or a combination of both as a trademark if they are unique and distinctive. This type of trademark protects combinations that represent your brand, preventing others from using them in a similar context.
Example: hp
A Device Mark refers to a trademark that includes a logo, design, symbol, or any graphic element that uniquely represents your brand. Unlike word marks, which focus solely on the text, device marks emphasize the visual components associated with your brand.
Example: Allen Solly
A Monogram Trademark is a logo or symbol consisting of letters (often initials) that are designed in a stylized, interconnected manner to represent a brand.
Example: Legal Terminus LT
A Colour Mark is a trademark that protects a specific color or a combination of colors that is used uniquely by a brand. The color(s) must be associated with the brand and serve as an identifier for the brand’s goods or services.
Example: Coca-Cola Red
A Shape Mark is a type of trademark that protects the product shape or packaging shape or store layout of a product or its container.
Example: Appy Fizz
A Sound Mark is a type of trademark that protects a unique sound used to represent a brand or product. These marks can include jingles, musical notes, or other distinctive sounds that are strongly associated with a brand.
Example: Tune of Nokia
A Signature Trademark is a type of personalized signature that is used as a distinctive brand identifier. This could be the signature of the founder, CEO, or any significant figure associated with the brand.
Example: Signature of Sachin Tendulkar
The TM symbol shows that a brand is claimed by its owner, even if the trademark is not officially registered yet. It offers some level of protection, especially in case of brand disputes or misuse.
The R symbol means the trademark is officially registered with the authorities. It gives full legal protection and ensures only the owner can use the brand for specific goods or services.
The registration of a trademark grants its owner specific legal rights that are crucial for protecting their brand. Owning a registered trademark does not just allow the owner to use the mark; it primarily provides the legal authority to prevent others from using the same or a confusingly similar mark on related goods or services. This protection is essential for maintaining the uniqueness of a brand in a competitive market. These rights are confined within the territorial bounds of the country where the trademark is registered.
Enforcement and Legal Protections Against Infringement: Enforcing trademark rights is crucial for maintaining the economic value of a trademark and protecting business interests.
Control Over Licensing and Assignment: Registered trademark owners have control over the licensing and assignment of their trademarks. This enables them to authorize others to use their trademarks under specified conditions without losing their ownership rights.
Prevention of Unfair Competition: Trademark registration helps prevent unfair competition by prohibiting competitors from using similar distinguishing signs that can confuse consumers. This right helps maintain the uniqueness of the brand and ensures fair market competition.
Enhancement of Business Value: Registered trademark significantly enhance the value of a business, transforming them into recognizable symbols of quality and trust.
